Ed. Note: As a disclaimer, my son is a retired deputy sheriff sergeant and I normally support the police as much as possible. But when it comes to supporting police officers like this bozo, NO!
This guy’s behavior is a stain on police everywhere!
New Jersey as we know is a bastion of leftist liberal jackasses. New Jersey is one of if not the most liberal states in the nation, harboring some of the most idiotic people in the nation.
And that sadly, includes cops. Liberal cops are dangerous cops. Ergo some Jersey cops are dangerous idiots.
Case in point, New Jersey State Trooper Joseph Drew.
This guy drifted so far from propriety that it is likely he will be (hopefully) fired and successfully sued into bankruptcy. I damn well wouldn’t want to be stopped by a cop like him!
When you violate someone’s civil rights and do it WITH MALICE and stupidly make biting, antagonizing, threatening remarks while doing so, that indicates intent! Making you at best an ass, at worst a rogue cop.
Civil rights prosecutions in these kinds of lawsuits often result in PERSONAL CULPABILITY and LIABILITY, meaning that if you’re sued after doing something like this (and this guy will almost certainly be sued), you can be held PERSONALLY LIABLE for damages assessed!
This wise-ass, big-mouth, meanspirited arrogant cop is probably in a heap of trouble.
First of all, unless the VICTIM gave permission to search his car (the cop alleging he “smelled marijuana” may not be sufficient probable cause here), the search itself was illegal. Making everything that followed “fruit of the poisonous tree.” Yes, that is oversimplifying a bit, but the ensuing search of the VICTIM’S person certainly was an illegal search. All he had to do was call for a K-9 if he suspected marijuana. An alerting dog is probable cause.
Unfortunately, judges almost always believe a cop, so if he SAYS he “smelled marijuana,” a judge would probably believe him. Cops do lie as we have seen numerous times recently, and that’s a problem.
The cop was in no immediate danger, he had a backup, there was NO probable cause to suspect a weapon or search the man as he did, especially while verbally assaulting the victim.
The cop was by then on a ‘fishing expedition,’ trying desperately to find ‘evidence’ after the fact and find something, anything, to justify the illegal search.
In the video, if you listen carefully, you’ll hear the cop become nasty, threatening, and make unnecessary personal remarks — clearly stating that he intended to become even more aggressive in his search. He was clearly trying to intimidate the VICTIM.
Dishonest, overly zealous cops like this guy probably do this more often than we know, making traffic stops for minor infractions, alleging questionable “probable cause” to justify making a search of a vehicle or person to try to find something… anything…
I know for a fact that happens, and it happens way too often.
If you’re stopped for a traffic infraction, if asked for permission to search your vehicle, DO NOT GIVE IT! There is no valid reason to search a vehicle if stopped for a traffic violation! It is ALWAYS a ‘fishing expedition.’
You’ll often see police looking INTO the vehicle, but reaching into it, touching anything inside it, etc. is a ‘no-no.’
Most people are afraid to refuse a search request, thinking they will “anger” or annoy the cop [you could], who might say something like “What are you afraid of? Or “What do you have to fear if you’re innocent?” Which are actually phrases designed to get you to comply out of fear.
It may be true in some cases that some cops could become annoyed or even angry if refused a search. But if the cop you’re afraid to anger actually does become angry at a perfectly justified and legal refusal, he’s probably up to no good, isn’t he?
I don’t know what was in the mind of Trooper Drew, but we’re going to find out eventually, that’s for sure, because I imagine he WILL be sued.
I’d also be surprised if there isn’t an immediate apology forthcoming from the New Jersey State Police and some kind of internal action/investigation regarding the trooper.
BUT THAT IS NOT ENOUGH!
This guy needs to be FIRED!
Because he needs to learn a lesson that becomes a teaching moment for police everywhere.
As I wrote earlier, I avidly support the police, who have a difficult, mostly thankless job. I don’t envy them. Not at all. But when a rogue police officer like this jerk surfaces, immediate and forceful action is called for — because people like him soil the reputation of police everywhere.
And remember, even President Trump doesn’t believe in your rights! That’s right, Trump said regarding SEIZING GUNS, “We’ll get the guns first and worry about due process later!”
